In Re: CAN 1 of 2025 16.05.2025 Court No. 35 Item No.17 Rakib Learned advocate for the private respondent nos. 7 to 12 has taken out an application for recalling the order dated 20.03.2025.

Learned advocate for the petitioner is present. Mr. Banerjee, learned Additional Government Pleader appears on behalf of the State.

Mr. Ganguly, learned advocate appears on behalf of the Municipality.

Having regard to the earlier order so passed on 20.03.2025 and the report so submitted by the State today, I direct that the same is modified to the limited extent that the police authorities would act only if the Municipal Authorities directs the police authorities to act in a particular manner.

With the aforesaid observations CAN 1 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be circulated to all the parties. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
