06.02.2024 (D/L-66) Ct.-18 (Susanta) W.P.A. 17309 of 2022 Koyel Mitra -Vs- The State of West Bengal & Ors.

Mr. S. P. Lahiri, Mr. Rajesh Naskar, Mr. Srijit Halder, .... For the Petitioner. Mr. Sourav Mitra .... For the S.S.C. Affidavit-of-service filed on behalf of the petitioner be kept with the record.

The petitioner is an Assistant Teacher of the subject Mathematics at Chuprijhara Khaldhar Para Junior High School, District-24- Parganas (South), she applied for general transfer through 'Utsashree Portal' on the grounds that she has suffered severe burn injuries and that the distance between her residence and the school is more than 154 kilometres.

The School authority has refused to issue required 'NoObjection' to the said prayer of the petitioner on the ground that she is the single teacher of the subject in the school, consequently the West Bengal Central School Service Commission has rejected the application of the petitioner.

Mr. Lahiri, learned advocate for the petitioner strenuously argues that the ground of rejection is not sustainable. Be that as it may, the "Utsashree Portal" is now under suspension, as such, the prayer of the petitioner for general transfer cannot be considered at this stage.

W.P.A. 17309 of 2022 is therefore dismissed without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
