The writ petitioner is aggrieved in that he has been called to appear before the wilful defaulter committee of the PNB without furnishing to him a copy of the forensic audit report and statement of accounts. The writ petitioner claims to have formally requested for aforesaid documents from the bank. Counsel for the bank submits that the said documents were always available to the writ petitioner. This submission has been denied by counsel for the writ petitioner.

This Court is of the view that the proceeding may premature since there is no final order holding the petitioner as a wilful defaulter till date, to address the question of any prejudice to the writ petitioner, even if the allegations in the writ petition are taken to be true. The writ petition is therefore disposed of without any order at this stage reserving rights to the petitioner to challenge the final order as and when passed. There will be no order as to costs.
