Since the innocuous prayer of the petitioner is for expeditious disposal of ACM 480 of 2023 under Section 125 of the Code of Criminal Procedure pending before the learned Judicial Magistrate, 10th Court, Alipore, South 24 Parganas the matter may be disposed of without service of notice upon the opposite party.

The opposite party shall not be prejudiced by an order directing expeditious disposal of the case. This Court is informed that the application under Section 125 of the Code was filed by the petitioner on 3rd June, 2023 along with an application seeking interim maintenance. The opposite party appeared before the learned Trial Court on 18th November, 2023 and since then there has been no progress in the matter. The application for interim maintenance has also not been considered. In view of the above, the learned Trial Court is directed to consider and dispose of the application for interim maintenance on the next date of hearing fixed before him and in the event the same is not possible

within one month from the said date. The learned Trial Court shall also make all endeavours to dispose of the application under Section 125 of the Code as expeditiously as possible, preferably within one year from the date on which the application for interim maintenance is disposed of, without granting any unnecessary adjournment to either of the parties, in accordance with law. The revisional application being CRR 2869 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
