Heard learned counsels for the parties.

The petitioner is in custody for more than 5 years and prays for bail.

Learned counsel for the petitioner submits that there is little progress in trial of the case and only 6 out of 27 witnesses have been examined so far. Evidence of the 7th witness is going on. Witnesses have not turned up before the learned trial Court.

Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner has been implicated in murder of a person. He has been identified by the witnesses before the learned trial Court. He is in custody for more than 5 years. Offence, if proved, shall attract mandatory life imprisonment. Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

However, in view of the prolonged incarceration of the petitioner, the learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The application for bail is thus disposed of. Case diary be returned.
