1. Admittedly, the notice under Section 41A has not been complied with.

2. We are not inclined to accept that the petitioner was innocent having regard to the inclement materials available in the case diary. Investigation is at the early stage. The involvement of the petitioner in the commission of the alleged offence cannot be ruled out.

3. Accordingly, the application for anticipatory bail is rejected.
