The petitioner is a government contractor and participated in a tender floated by the Executive Engineer, Burdwan North Highway Division-III on 29th February, 2008 for construction of service road from Komarpur to Chakta road from 0.00 kmp to 13.20 km under Ramjibanpur Highway sub-division. The petitioner being the lowest bidder was granted the contract for half of the total distance.
Upon completion of work completion certificate was issued by the Executive Engineer and total value of work was assessed at 83,34,001.44/-. The petitioner submits that out of the said amount Rs.17,15,001/- is still due. In view of the fact that the work has been completed by the petitioner in terms of the work order issued in his favour and completion certificate has been issued upon completion of the said work, the District Engineer, Purba Burdwan Zilla Parishad being the 4th respondent herein, is directed to take necessary steps for disbursement of the
remaining amount in favour of the petitioner within 6 weeks from the date of communication of this order. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
