Report submitted today reflects that the date for argument has been fixed by the learned trial court on 7th February, 2023. Let the same be kept with the record. The earlier report dated 13.11.2022 submitted before this Court reflects that the three witnesses, namely, Dr. Ritosh Chakraborty @ Ritesh, (C.S.W.11), Soumajit Roy, (C.S.W.14) and Siba Prosad Bose, (C.S.W.15) are available. The addresses are known to the Inspector-in-Charge, Katwa Police Station.
The Deputy Superintendent of Police/Sub-Divisional Police Officer having jurisdiction over Katwa Police Station will act as Nodal Officer of this case and will organize regarding the availability of the three witnesses named above on the date so fixed
by the learned trial court.
It has been informed that the next date is fixed on 7th February, 2023.
The learned trial court would postpone hearing of the arguments and complete the examination of the aforesaid three charge-sheeted witnesses preferably by fixing dates between 7th February, 2023 to 28th February, 2023. The learned trial court would thereafter complete the procedures, if required under Section 313 of the Code of Criminal Procedure and defence witness, if any and start hearing of the arguments of the case on and from 3rd April, 2023.
With the aforesaid observations, CRR 2268 of 2021 is allowed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
