2025-08-14Hon'Ble Justice Jay Sengupta2 pages

AD 45 August 14, 2025 Ct. 28 SG CRM(A) 2634 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Khargram P.S. Case No.298 of 2024 dated 18.08.2024 under Sections 179/180 of the BNS, 2023.

And In the matter of:

Seikh Sazad @ Sajjad Sk. @ Sarjad Sk.

... petitioner Mr. Navanil De Ms. Shoumilya Majumder ... for the petitioner Mr. A.A. Siddiqui ... for the State Heard learned counsels for the parties.

Perused the case diary.

It is the case of the prosecution that at the time of raid two persons could be arrested and the others fled away. The present petitioner is one of those two persons who fled away. There is also a statement of a neighbour stating that the petitioner and another had been indulging in such illegal act.

Considering the nature of allegations and the materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Jay Sengupta, J.)
