CRM (M) 1179 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Khargram Police Station Case No. 30 of 2025 dated 29.01.2025 under Sections 103(1)/351(2)/61(2) of the Bharatiya Nyaya Sanhita. And In Re : Subhas Ghosh ... Petitioner.

Mr. Navanil De Ms. Monami Mukherjee ... For the Petitioner Mr. Soumik Ganguly Ms. Mamata Jana ... For the State Mr. Manas Kr. Das Mr. Aritra Kr. Talukdar ... For the Defacto Complainant The petitioner is in custody for more than 7 months and prays for bail.

Learned counsel for the petitioner submits that the petitioner's father has been granted anticipatory bail by this Court. The petitioner has been falsely implicated. The victim entered the house of the petitioner in inebriated condition and created ruckus. The petitioner objected to the same. His further detention is not required.

Learned counsels for the State and the defacto complainant oppose the prayer.

I have considered the material on record.

The petitioner appears to be principal assailant who dealt the fatal blow on the victim. Post occurrence witnesses have implicated the petitioner. Charge sheet has been submitted. Trial is about to commence.

Considering the prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The application for bail is disposed of.

Case diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
