Das .....For the Petitioner Mr. Swapan Banerjee Ms. Purnima Ghosh .....For the State The present revisional application has been preferred challenging the proceedings of G.R. Case No.149/12 which arise out of Marishda Police Station Case No.30/12 dated 17.02.2012 under Sections 147/ 148/ 149/ 448/ 342/ 379/ 427/ 307/ 436 and 506 of the Indian Penal Code read with Sections 25/ 27 of the Arms Act.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that in the complaint which was lodged with the police station more than 40 names were inserted and the name of the present petitioner was also inserted. There is no complicity or involvement of the present petitioner and he has been implicated in the case on a private and personal grudge to settle scores. Mr. Banerjee, learned advocate appearing for the State opposes such prayer and produces the Case Diary and draws the attention of this

Court to the letter of complaint as also the statement of one, Puspendu Adak.

Having regard to the complicity which has been described in the complaint as also the statement of a witness who has been relied upon in the charge-sheet, I am of the opinion that there is no scope for interference in respect of the proceedings which are continuing before the Learned A.C.J.M., Contai. Petitioner would be at liberty to canvass the points advanced in this revisional application at the stage of consideration of charges, as the same has till date not been framed by the learned Trial Court.

With the aforesaid observation, C.R.R. 2269 of 2021 is disposed of.
