Mun Mun Chakraborty v. West Bengal Central School Service Commission And ANR
03.05.2023 (D/L-08) Ct.-18 (Susanta) W.P.A. 17335 of 2022 Mun Mun Chakraborty -VsWest Bengal Central School Service Commission & Anr.
Mr. Sujit Saha, Ms. Swagata Datta, .... For the Petitioner.
Dr. Sutanu Kumar Patra, Ms. Supriya Dubey, .... For the S.S.C.
The petitioner participated in the 1st State Level Selection Test 2016 for recruitment of Assistant Teachers in Secondary and Higher Secondary Schools.
The petitioner applied for appointment in the post of Assistant Teacher, Physical Science (GRAD) in Hindi Medium Schools.
The candidature of the petitioner has been rejected on the ground that Hindi was not her First or Second language at Madhyamik or Higher Secondary level.
The petitioner relying on the Employment Notification dated February 16, 2016 contends that since she had Hindi in graduation level is entitled to the appointment applied for.
Dr. Patra, learned Counsel for the commission submits that the notification dated February 16, 2016 was cancelled by the subsequent notification
dated September 24, 2016 whereby it was clarified that the candidate willing to be selected must have Bengali, English, Hindi etc. as the First and Second language in Secondary and Higher Secondary level. The petitioner admittedly did not have the Hindi language as First or Second language in her Madhyamik or Higher Secondary level, as such, she is not entitled to be appointed in a Hindi Medium School. The rejection of the candidature of the petitioner, therefore, cannot be faulted.
Accordingly writ petition fails.
W.P.A 17335 of 2022 is thus, dismissed, without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
