Mr. Ratul Das Mr. Bijoy Bag ..for the petitioner in WPA 19394 of 2024 Mr. Sirsanya Bandopadhyay Mr. Arka Kumar Nag Mr. Tirthankar Dey ..for Bidhannagar Municipal Corporation The petitioners in all the aforementioned writ petitions challenge the demolition order dated May 11, 2023. It is noted that on July 10, 2024, an interim order was passed staying the operation of the demolition order. This interim order has subsequently been extended until July 18, 2025.
Today, it has been submitted on behalf of all the writ petitioners that they intend to avail themselves of the statutory remedy of appeal as provided under Section 266(3) of the West Bengal Municipal Corporation Act, 2006.
In light of the foregoing, there is no justifiable reason to keep these writ petitions pending.
Liberty is therefore granted to the writ petitioners to file an appeal before the Tribunal within one week from the date on which the certified copy of the demolition order is provided to them.
The Corporation is directed to supply the certified copy of the demolition order to the petitioners within two weeks from today, subject to the petitioners' compliance with the necessary formalities.
This Court has, from time to time, passed interim orders in these matters. In the interests of justice, the interim order currently in operation shall continue for a further period of two months from today.
Any extension of the stay order beyond this twomonth period shall be at the sole discretion of the Tribunal.
Given the pendency of these writ petitions before this Court, it is hereby clarified that if the appeal is filed within the stipulated time period, it shall be entertained notwithstanding any limitation issues.
Accordingly, WPA 17695 of 2024 with CAN 1 of 2024 and CAN 2 of 2024, WPA 15182 of 2023, WPA 19394 of 2024, and WPA 27763 of 2022 with CAN 1 of 2024 and CAN 2 of 2024 are hereby disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
