Mr. Uday Sankar Chattopadhyay, learned advocate appearing for the appellant submits that there has been inadvertent mistake on his part for incorporating the name of the victim. As such, learned advocate intends to withdraw the memorandum of appeal and file a fresh memorandum of appeal. Accordingly, the department is directed to return the certified copy and other necessary documents enclosed with the present memorandum of appeal.
Liberty is granted to the appellant to file fresh memorandum of appeal in respect of the same judgment and order of conviction and sentence.
