Heard the learned Counsels appearing on behalf of the parties.

Petitioner is in custody for about one and half years. It is submitted he was in control of the place from where recovery was made.

Learned Advocate for the State opposes the prayer for bail. He submits on the disclosure statement of co-accused viz., Subhankar Barui and on the showing of the petitioner 2000 phensedyl syrup containing codeine mixture was recovered from the godown of the petitioner.

In view of the aforesaid incriminating materials on record and the statutory restrictions under Section 37 of the N. D. P. S. Act, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

We direct the trial court to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
