25.11.2024 rc/ct.no.34 Item No.158 CRR No. 2873 of 2024 In the matter of : Darakshan Parveen .......Petitioner Mr. Debapriya Majumder ...for the Petitioner Since the petitioner seeks expeditious disposal of the proceedings being Domestic Violence Case No. 89 of 2018 pending before the learned Judicial Magistrate, 3rd Court, Sealdah, South 24- Parganas the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the matter.

It appears from the record that the case is pending since 2018. Interim maintenance was initially granted to the petitioner against which the opposite parties approached the appellate forum and the order of interim maintenance was turned down. Again, interim maintenance was granted to the petitioner and the said order was assailed by the opposite parties before the learned appellate forum in criminal appeal which is pending. Learned counsel for the petitioner submits that no order of stay of proceedings has been granted by the learned appellate forum.

It appears that several dates for recording of evidence have been fixed by the learned Trial Court despite which evidence has not been recorded.

In view of the above, the learned Trial Court is directed to conclude the trial within six months from next date fixed before him without granting any unnecessary adjournment to either party, in accordance with law.

CRR No. 2873 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
