The present revisional application has been preferred against an order dated 15.09.2021 passed by the learned Additional Sessions Judge, 1st Court, Katwa in Criminal Revision No.41 of 2021 by affirming the impugned order dated 03.12.2020 passed by the learned Judicial Magistrate, 3rd Court, Katwa in Misc. Case No.39 of 2019.

By the said judgement under revision, the learned Session Judge while deciding the revision against an order of the learned Magistrate under Section 127 of the Cr.P.C was pleased to hear the case on merit and dismissed the same.

That there is no representation on behalf of the petitioner since listing.

The revisional application is accordingly disposed of with the observation that the order under challenge relates to an application under Section 127 of the Cr.P.C and as such the parties shall have the liberty to pray for relief under the said provision in changed circumstances.

5. All applications connected thereto stand disposed of.

6. Interim order, if any, stands vacated.

7. Let a copy of the order be sent to the learned trial court for compliance.

8. Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities. ( Shampa Dutt (Paul), J. )
