Mr. Anirban Tribedi, Mr. Supratick Syamal ... for the petitioner Mr. Amal Sen, Mr. Benazir Ahmed ... for the State Mr. Atarup Banerjee ... for the respondent no. 2 After hearing learned counsel for the petitioner and the respondent no. 2 being the Secretary, West Bengal Clinical Establishment Regulatory Commission, it appears that the compensation of Rs. 5 lakhs, which was to be given by the respondent no. 3 Hospital, was deposited by the Hospital in the account of the respondent no. 2. The amount of Rs. 5 lakhs remaims in the account of the respondent no. 2 as on date. Learned counsel appearing for the respondent no. 2 submits that the respondent no. 2 is ready to immediately transfer the amount to the account of the petitioner providing the petitioner gives his bank details to the respondent no. 2.

The petitioner shall hence be at liberty of providing his bank details and other documentation, as required in terms of the order passed by the Commission on 12th February, 2020, within one week from today. The Commission shall thereafter transfer the amount of Rs. 5 lakhs to the account of the petitioner within a week from the date on which the Commission receives the bank particulars from the petitioner.

It is made clear that the petitioner shall deposit the said amount in the fixed deposit account as directed by the Commission in the order dated 12th February, 2020.

WPA 17339 of 2022 is disposed of in terms of the above.
