Matter is heard in presence of the learned advocates representing the petitioners and the State respondents.

It is submitted by the learned advocate representing the petitioners that they have a right over the land in question to cultivate. However, private respondents are creating disturbance affecting right of the petitioners to cultivate the land in question as a result whereof petitioners have approached this Court with the present writ petition.

Prayer is made in this writ petition to give direction upon the concerned police authorities which would ensure right of the petitioners to cultivate the land in question.

Mr. Swapan Banerjee, learned Additional Government Pleader appearing on behalf of the State respondents has filed a communication dated 31st July, 2025 of the Sub Inspector of Police, Officer-in-Charge,
Sandeshkhali Police Station, North 24 Parganas and same is taken on record. Copy of the said communication dated 31st July, 2025 is made over to the learned advocate representing the petitioner. 5.
It is submitted on behalf of the State respondents that the issue is concerning right to cultivate the land in question and petitioners as well as private respondents are claiming their respective rights over the land.

Having considered the respective submissions made on behalf of the parties, Court finds that the issue involved in this writ petition is civil in nature requiring petitioners to approach the appropriate forum. Police authorities are not authorized to decide the inter se right of the parties over the land in question.

Hence, writ petition stands dismissed.

However, this order shall not preclude the petitioners to take steps, in accordance with law.

Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
