Saswata And In the matter of : Dr. Sayid Hossain

...Petitioner

Mr. Musharraf Alam Sk.

... for the petitioner Mr. Pravas Bhattacharya Mr. Suman Saha ...For the State.

Petitioner prays for anticipatory bail.

Learned advocate appearing for the petitioner submits that the police complaint was lodged 4 years after marriage. The petitioner is a doctor by profession. The petitioner is ready and willing to pay for the maintenance of his wife as well as his child. The petitioner applied for restitution of conjugal rights. Learned advocate for the State draws the attention of the Court to the materials in the case diary. He submits that prior to the lodgment of the present police case, there were complaints to the police with regard to the wrong doings of the petitioner. The petitioner is the husband. The police compliant was lodged within 7 years of the marriage.

Considering the materials in the case diary involving the petitioner in the instant case, we are not inclined to grant anticipatory bail to the petitioner.

The prayer for anticipatory bail being CRM (A) 3704 of 2022 is, thus, rejected.
