Das .....For the Petitioner Mr. Ranabir Roychowdhury Mr. Mainak Gupta .....For the State The present revisional application has been preferred challenging the proceedings in G.R. Case No.151/12 which arise out of Marishda Police Station Case No.29/12 dated 17.02.2012 under Sections 147/ 148/ 149/ 448/ 379/ 427/ 436/ 307 and 506 of the Indian Penal Code read with Sections 25/ 27 of the Arms Act.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that the complaint which was lodged with the police station more than 40 names were inserted and the name of the present petitioner was also inserted. There is no complicity or involvement of the present petitioner and he has been implicated in the case on a private and personal grudge to settle scores. Mr. Roychowdhury, learned advocate appearing for the State submits that the present case is a sessions triable offence and the

complainant at the very inception disclosed the name of the present petitioner alongwith others describing his complicity in the alleged offence. The complainant, Sandhya Jana is the first witness of the prosecution in the charge-sheet.

Considering the fact that the complainant is yet to be examined, I do not think that this is a proper case for interference, at this stage. Petitioner would be at liberty to agitate the points canvassed in this revisional application at the appropriate stage of the proceedings. With the aforesaid observation, C.R.R. 2271 of 2021 is disposed of.
