Re : CAN 1 of 2024 This is an application for restoration of the writ petition being W.P.A. No.17341 of 2022, upon recalling the order dated March 8, 2024, by which the writ petition being W.P.A No.17341 of 2022 had been dismissed for default. Having perused the grounds stated in paragraphs 3 and 4 of this application, this Court is satisfied that the petitioners were prevented by sufficient cause from appearing before the Court when the writ petition was dismissed for default. Let the order dated March 8, 2024 be recalled.
The writ petition being W.P.A. No.17341 of 2022 is restored to its original file and number.
The application being CAN 1 of 2024 is allowed and disposed of accordingly.
Re: W.P.A. No.17341 of 2022 It is submitted by the learned Advocate for the petitioners that the respondent Nos.9 and 10 could not be served. Service be effected by speed post. The petitioners will also put insertions in two widely circulated newspapers; one in English and one in Bengali in the locality where the said respondents reside.
As it is submitted by Mr. Mitra, learned Advocate for the State that investigation is complete and charge sheet has been filed, a fresh report indicating the details of the trial be filed.
