Ms. Amrita Panja Moulick .....for the petitioners Mr. Santanu Kr. Mitra, Sr. Govt. Adv., Mr. Subhabrata Das ....for the State 1) The grievance of the petitioners has been addressed. None appears on behalf of the respondent Nos. 9 and 10.

2) It appears that the respondent no. 9 has been suspended. The criminal investigation is over. Charge-sheet has been filed. The respondent no. 9 was in judicial custody. Thereafter the respondent no. 9 was released on bail. The date has been fixed by the learned criminal Court for framing of charge.

3) In view of the fact that the matter is before the learned criminal Court and there are prima facie evidence for commission of offence, the employer shall be at liberty to initiate the disciplinary proceeding in accordance with law, and strictly in terms of the service rules.

4) Accordingly, the writ petition is disposed of.

5) Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
