It has been submitted that the Municipality accepted the fees at the time of submission of the application for issuance of revised sanctioned plan.

Learned counsel representing the Municipality submits that the initial plan was sanctioned in 2014 and the same has expired by now. There is no scope for revising the plan which does not exist at all. Be that as it may, as the application seeking revised sanctioned plan is alleged to be pending before the Municipality, accordingly, the present writ petition is disposed of by directing the Chairman, Rajpur Sonarpur

Municipality to communicate the petitioner the fate of the application praying issuance of revised sanctioned plan. In the event the prayer of the petitioner is refused, then the grounds for refusal of the application shall be specifically mentioned.

Such exercise shall be completed at the earliest but positively within a period of six weeks from the date of communication of a copy of this order.

WPA 17344 of 2022 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
