There is civil suit between the parties in which the petitioner is enjoying injunction against the private respondents from interfering with the possession of the property.

Counsel for the petitioner submits that by reason of threats and intimidation by the private respondents, he is not able to return back to this property.

Counsel for the private respondents submits that there is absolutely no question of threat on his clients' part. In respect of an FIR that has been registered by the Bhupatinagar Police Station. Charge sheet has been filed against the petitioner and the petitioner is enlarged on

bail. The petitioner is voluntarily residing outside the said village.

In view of the above, the petitioner may return to his village and his residence forthwith. In the case of any apprehension, the Officer-inCharge, Bhupatinagar Police Station shall render assistance to the petitioner.

The parties shall, however, strictly abide by the injunction passed by the Civil Court or as may be ordered by any higher forum. Appropriate steps may be taken by the parties in respect of such injunction in accordance with law.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
