Let the report of the Inspector-in-charge, Kalyani Police Station, RPD dated 23rd August, 2022 addressed to the Government Pleader, High Court, Calcutta be taken on record.

It appears from the said report that one Kaushik Ghosh, the respondent no.10, the original owner of the vehicle, had sold it to one Balai Das against a demand draft. It also appears from the said report that the draft was dishonoured as fake. The said Balai Das in turn sold the vehicle in question to the petitioner. Upon receipt of a complaint from Kaushik Ghosh, FIR has been registered by Kalyani Police Station being Case No. 247 of 2022 dated 23.05.2022 under Sections 420/406/34 of the Indian Penal Code. The petitioner claims that he is being continuously threatened by the S.I., one Jayanta Thakur, Investigating Officer of the case of Kalyani Police Station.

Since the petitioner claims to be a bona fide purchaser for value of the vehicle, the said Jayanta Thakur shall not threaten the petitioner or call him.

Investigation may be completed as expeditiously as possible and the said Balai Das must be apprehended. B. Garden Police Station shall submit a detailed report on the steps taken in respect of the complaint of the petitioner. They shall ensure that there is no breach of peace around the house of the petitioner. The petitioner shall extend all co-operation in the investigation.

Let this matter stand adjourned and be listed on 10th November, 2022 under the same heading.
