The State of West Bengal and others Mr. Joy Chakraborty, Mr. Subhendu Roy Choudhury, Mr. Sandip Dindu .... for the petitioner Mr. Pantu Deb Roy, Mr. Subrata Guha Biswas .... for the State Learned counsel for the petitioner contends that despite the petitioner's representations on behalf of all the forty-five auto rickshaws, which are members of the petitioner-Union and plying on route 10 (CanningBasanti), the respondent-authorities have not taken any steps in respect of the alleged illegal plying of auto rickshaws by several persons.

Upon hearing learned counsel for the parties, without entering into the merits of the allegations made by the petitioner, which would be prejudging the issue prior to a decision being taken by the authorities, I am of the view that the ends of justice would suffice if the respondents are directed to decide on the representations of the petitioner in accordance with law.

Accordingly, WPA No. 17352 of 2022 is disposed of by directing the respondent-authorities to consider and decide on the representation dated July 08, 2022 made by the petitioner-Union (annexed at page-13 of the instant writ petition) upon hearing all concerned parties, taking into consideration the relevant provisions of law and the other criteria which are to be looked into for such purpose, upon giving adequate opportunity of hearing to all interested parties, as expeditiously as possible, preferably within eight weeks from date.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
