Versus

The State of West Bengal & Ors.

1. The petitioner has filed this writ petition alleging that there is an encroachment into a water body. In this regard a representation dated 3rd July, 2023 has been submitted. Since no action had been taken, the present writ petition has been filed.

2. The learned Government counsel would submit that the authority may be directed to consider the representation.

3. Hence, without going into the merits of the allegations made by the writ petitioner, there will be a direction to the 7th respondent viz., the Block Land & Land Reforms Officer, Nandigram-I to consider the representation dated 3rd July, 2023, conduct an inquiry and take action in accordance with law.

4. The petitioner is directed to appear in person in the office of the 7th respondent and submit a copy of the representation along with annexures as well as a copy

of this order to enable the authority to comply with the above direction.

5. The above direction shall be complied with within a period of 12 weeks from the date of receipt of copy of the representation in terms of the above direction.

6. With the aforesaid directions, the writ petition is disposed of.

7. No costs.

8. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
