The instant application under Article 227 of the Constitution of India is at the instance of the plaintiffs in a suit for declaration and injunction which is directed against the order dated July 27, 2023 passed by the 2nd Court of learned Civil Judge (Junior Division), Paschim Medinipur in the said suit being Title Suit No.68 of 2005. The learned Trial Judge by the order impugned has dismissed the application filed by the plaintiffs praying amendment of their written statement on the ground that the trial of the suit has commenced long back in the year 2010 and application for amendment has been filed in the year 2019.
This court does not find any reason to interfere with the order impugned.
CO 2470 of 2024 is dismissed with no order as to costs. The suit is pending since 2005; the learned Trial Judge is requested to expedite the disposal of the suit in accordance with law, and in doing so, shall not grant any unnecessary adjournment to either of the parties.
