The petitioner being aggrieved by the fact that the police authorities are not properly investigating Dholahat P.S. Case No. 275 of 2024 which was registered for investigation under Sections 302/120B of the IPC has prayed for transfer of the investigation of the said case.
State has submitted a report which reflects that in course of the investigation two of the accused persons namely, Subrata Pramanik and Monirath Ari were arrested and various offending
weapons were also traced out. The statements of various witnesses were taken into account and, on conclusion of the investigation, charge-sheet was submitted before the learned jurisdictional court in August, 2024 under Sections 302/201/120B of the IPC. According to the learned advocate for the State the motive behind the crime has also been established.
Be that as it may, the petitioner approached this court at a stage when the petitioner was under impression that the investigation of the case was not progressing.
Report submitted before this court reflects that charge-sheet has been submitted. In case, the petitioner has any further grievance, the petitioner would approach the learned Magistrate or the court in seisin of the case presently by taking out an appropriate application, if so advised, under Section 173(8) of the
Cr.P.C.
With the aforesaid observations, WPA 17754 of 2024 is disposed of.
Pending application(s), if any, is also disposed of.
Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
