Sl.No.

28.01.2025 WPA 17763 of 2024 Court No. 35 G.S.Das Krishna Mahali -VsThe State of West Bengal & Ors.

Mr. Saibal Acharyya Mr. Pradip Paul ... for the petitioner(s) Mr. Ansar Mandal, ld. AGP Mr. Asish Dutta ... for the State-respondent(s) Mr. Rabindranath Mahato Mr. Aritra Shankar Ray ... for the respondent nos. 9-12 The petitioner is aggrieved by the fact that the private respondents have been cutting down the trees from his land and an information, to that effect, was furnished to the police authorities which did not yield any result.

Learned advocate for the State has submitted a report, which reflects that Kharagpur Local P.S. Case No. 724 of 2024 dated 28.08.2024 was registered for investigation under Sections 447/379/34 of

the IPC and Section 11 of The West Bengal Trees (Protection and Conservation in Non-Forest Areas) Act as well as Section 3(1)(g) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned advocate for the private respondents submits that they were granted permission by the irrigation department for renovation of the canal which permitted them to act in a particular manner.

Be that as it may, since the main grievance of the petitioner was that the information furnished, although disclosed cognizable offences, the police authorities did not act on the same as also the report which reflects that the police authorities have already registered a case, I direct the police authorities to take the investigation to its logical conclusion by

effectively carrying out the investigation under the relevant provisions of law.

The report also reflects that the superior officer of the police is already investigating the case.

In view of the aforesaid, I am of the opinion that the purpose for which the writ petition has been preferred has been subserved.

With the aforesaid observations, WPA 17763 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the report.

Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
