Court No. 19 WPA 16838 of 2025 (265719) Nilendu Chakraborty 11.06.2026 (A 91) (S. Banerjee) Vs.

State of West Bengal & Ors.

Mr. Prosenjit Roy Ms. Abira Bhattacharjee ...for the petitioner Mr. Nilanjan Bhattacharjee, Sr. Advocate Ms. Jayita Dhar Chakraborty ...for the State The petitioner has challenged the encroachment made upon his property by the private-respondents. This Court finds that the dispute involved in this writ petition is purely a civil dispute. Mr.

Bhattacharjee, learned Sr.

Standing Counsel representing the State raises an objection as to the maintainability of this writ petition. The issue of encroachment by a private-party upon the petitioner's land, cannot form the subjectmatter of a writ petition. For such reason, the writ petition is not entertained. Accordingly, the writ petition stands dismissed as not entertained.

It is, however, made clear that this order shall not preclude the petitioner from approaching the

proper forum for appropriate relief in accordance with law.
