It is submitted on behalf of the petitioner that the illegal decision to auction a pond, which belongs to the State, is the core dispute raised by the petitioner.
On behalf of the State it is submitted that there is no allegation insofar as the State is concerned and the Pradhan has to decide the subject auction in accordance with law.
In view of the allegations made on behalf of the petitioner, W.P.A. No. 17782 of 2024 stands disposed of by directing the Pradhan, Tapan Chandipur Gram Panchayat, being the respondent no. 5 herein, to consider and dispose of the representation of the petitioner within a period of six weeks from the date of communication of this
order to the said respondent, strictly in accordance with law and without being influenced by any of the observations and directions made in this order. It is made clear that there has been no adjudication on the merits of the case and all questions are left upon to be decided by the concerned Pradhan in accordance with law.
There shall be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
