Affidavit-of-service filed by the petitioners be kept with the record.

Petitioners are aggrieved by the inaction of the police authorities as in spite of informing the Officer-in-Charge, Uluberia Police Station, no steps have been taken. To that effect, petitioners have enclosed Uluberia P.S. G.D. Entry No.2083 dated 24.06.2025. According to the petitioners, it was at the instance of the private respondents, a Title Suit was preferred before the learned Civil Judge (Senior Division), Uluberia but subsequently the said suit was dismissed. On dismissal of such suit, the

respondents by use of their muscle powers have encroached the property of the petitioners.

State has submitted a report. Report reflects that police authorities have drawn up proceedings under Section 126 of the BNSS and also contended that a long standing land dispute is existing between the petitioners and the private respondents.

Learned advocate for the private respondents submits that the suit was dismissed for default and an application for restoration has been preferred before the jurisdictional court.

Having considered that the police authorities are well aware regarding the dispute between the petitioners and the private respondents, I am of the view that police authorities would keep a strict vigil and take steps as and when there is violation of any law and order.

With the aforesaid observations, WPA 16807 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
