A spot inspection report by the Uttarpara - Kotrung Municipality has been placed before this Court.

It appears therefrom that there has indeed been unauthorized construction.

The Municipality directed the person responsible to stop further construction till finalization of the case by the Board of Councillors.

Copy of the report has been forwarded to all the parties.

In the aforesaid facts and circumstances, the Board of Councillors, Uttarpara-Kotrung Municipality is directed to take steps in accordance with law to deal with the unauthorized construction upon giving prior notice of hearing to all the parties.

The proceedings shall be concluded at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order. The reasoned order by the Board of Councillors shall be communicated to the parties.

The inspection report by the Urrarpara-Kotrung Municipality dated 22nd December, 2022 be retained with the records.

The writ petition and the connected application are disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
