The State of West Bengal & Ors.

Mr. Sattwik Bhattacharyya Mr. Aashutosh Bhattacharyya Mr. Aritra Roy Mr. Titas Niyogi ... for the petitioner.

Ms. Debleena Dasgupta ... for the State.

The petitioner prays for consideration of the representation made on its behalf by the learned advocate praying for disbursing the claim of the petitioner. The petitioner refers to the memorandum issued by the Finance Department being No. 6284-F(Y) dated September 28, 2018 followed by the order of the West Bengal State Rural Development Agency bearing the FC-1882/WBSRDA/2E-58/2018 dated November 20, 2018.

Without going into the merits of the claim raised by the petitioner, as it appears that the representation filed by the petitioner is pending consideration at the end of the Panchayat & Rural Development Department, accordingly, the instant writ petition is disposed of by directing the Chief Engineer, HQ Panchayat & Rural Development WBSRDA to consider the representation filed on behalf of the petitioner in accordance with the

relevant guidelines and pass a reasoned order and communicate the same to the petitioner.

An opportunity of hearing be given to the petitioner to place on documents in support of its claim. A decision shall be taken in the matter at the earliest but positively within a period of ten weeks from the date of communication of this order.

In the event any amount is found due and payable, the same shall be released on behalf of the petitioner at the earliest.

It is made clear that the Court has not gone into the merits of the claim of the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation. Learned advocate for the petitioner is directed to forward a copy of the representation along with the memos relied upon by the petitioner at the time of communicating the order of the Court.

The writ petition stands disposed of.

Affidavit-of-service filed in Court today is taken on record.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
