Banerjee) Mr. Nilendra Narayan Ray ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 2nd Court at Howrah to dispose of the application under Order 26 Rule 18 of the Civil Procedure Code filed in Title Suit No. 390 of 2015. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

From the order-sheets appended to this application this court finds that July 31, 2024 has been fixed for hearing of an application under Order

26 Rule 18 of the Civil Procedure Code and for filing written objection in the meantime.

Learned advocate appearing for the petitioner submits that August 27, 2025 has been fixed for hearing of the application under Order 26 Rule 18 Civil Procedure Code. He further submits that the written objection to such application has already been filed in the meantime.

In the light of the submissions made by the learned advocate appearing for the petitioner, CO 2474 of 2024 stands disposed of by requesting the learned Civil Judge (Sr. Division), 2nd Court at Howrah, to take up the hearing of the application under Order 26 Rule 18 of the Civil Procedure Code on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to see that the same is disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
