Mr. Chakraborty, learned advocate appearing for the petitioner submits that though the petitioner herein was present as a witness on May, 2025 but the opposite party prayed for time and the same was allowed. He submits that the next date has been fixed on November 26, 2025 for evidence. He further submits that the petitioner being a father of a minor daughter aged about twelve years could not meet his daughter since March, 2025.

It will be open to the petitioner to take appropriate steps in that regard before the learned District Judge, Krishnanagar, Nadia.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing

for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge.

From the ordersheets appended to this application this Court finds that 26th November, 2025 has been fixed for evidence of the petitioner.

In the light of the submissions made by the learned advocate for the petitioner, C.O. 2688 of 2025 stands disposed of by requesting the learned District Judge, Krishnanagar, Nadia to make an endeavour to dispose of the Act VIII Case No. 26 of 2022 as expeditiously as possible but preferably within a period of six months from the next date fixed without granting any unnecessary adjournments to either of the parties.

This order has been passed taking note of the fact that it is a proceeding under Act VIII and the same is pending from the year 2022.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
