Learned advocate appearing for the petitioner submits that, one of the other co-accused was granted anticipatory bail and that the police submitted charge-sheet. Consequently, custodial interrogation of the petitioner is not required. Learned advocate appearing for the State opposes the prayer for grant of anticipatory bail. He submits that, there are criminal antecedents of the petitioner. Moreover, there are statements recorded under Section 161 of the Code of Criminal Procedure implicating the petitioner in the offence. Considering the materials in the case diary and considering the gravity of the offence and complicity of the petitioner therein, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM 7405 of 2021 is dismissed.
