Heard learned counsels for the parties.

The petitioner is in custody for about 9 months and prays for bail.

Learned counsel for the petitioner submits that the seizure list reflects joint recovery of fire arms from the petitioner and another co accused. There is nothing on record to implicate the petitioner in an offence under Section 111 of the BNS. His further detention is not required and he may be released on bail.

Learned counsel for the State opposes the prayer. I have considered the material on record. Huge number of fire arms have been recovered from the petitioner and the co accused. The tower location and the CDRs prima facie indicate that the petitioner had gathered arms from Patna and thereafter entered into this State, after which he was apprehended and arms recovered.

Learned counsel for the State submits, on instructions, that the prosecution proposes to examine 7 witnesses, out of whom 5 witnesses have been examined. It is expected that trial shall conclude within a reasonable period of time.

Considering the material on record and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.

The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The application for bail is thus disposed of. Case diary be returned.
