C.R.M. 7412 of 2021 (Via Video Conference) (AD) 27.01.2022 Court No.29 (Rejected) In Re: - An application under Section 439(2) of the Code of Criminal Procedure.

And In the matter of: - Md. Israil Molla ...petitioner.

Mr. Ranjan Saha ... for the petitioner.

Mr. Rudradipta Nandy ... for the State.

Petitioner seeks cancellation of bail.

The petitioner was required to serve a copy of the application and file an affidavit of service to such effect by the order dated December 3, 2021. The petitioner does not file any affidavit of service.

State is represented.

Learned Advocate appearing for the petitioner submits that subsequent to the grant of bail, the opposite party nos.2 to 22 were involved in another criminal offence.

Learned Advocate appearing for the State submits that no condition of bail was violated by any of the opposite parties. The other incident will be dealt with in accordance with law. In view of the respective stands taken by the parties as noted above, we find no reason to cancel the bail subsisting in favour of the opposite party nos.2 to 22. The petitioner is unable to

establish any ground for cancellation.

Accordingly, the application for cancellation of bail of the petitioner is rejected.

C.R.M. 7412 of 2021 is dismissed.
