21-08-2024 (ct. no.28) KOLE CRM (DB) 2193 of 2024 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with New Town Police Station Case No. of dated 20.04.2023 under Section 419/420/406/467/468/469/471/120 of Indian Penal Code. - A n d - In the matter of : Pallab Sarkar @ Dodon .... Petitioner.

Mr. Sagar Saha, Mr. Manojit Debnath, Mr. N. Seikh, ... For the Petitioner.

Mr. B. Bhattacharyya, Ms. Jonaki Saha, ... For the State.

Mr. Moyukh Mukherjee, Mr. Abhijit Singh, .... For the defacto complainant.

Order dictated by Arijit Banerjee, J.:

1.

The petitioner renews his prayer for bail which was rejected earlier on January 25, 2024. He says that he is in custody for one year three months. The trial has not progressed at the desired pace. He should be enlarged on bail. 2.

While opposing the prayer for bail, learned Advocates for the State and the defacto complainant draw our attention to the available material. It appears that allegedly the petitioner had duped and defrauded several persons by meting out false promises of obtaining bar license for them or giving jobs, against payments collected by him from such persons.

3.

In view of such profile of the petitioner, it will not be proper to release him on bail as he may repeat the same crime. 4.

CRM (DB) 2193 of 2024 is, thus, dismissed.

5.

However, since the petitioner is in custody for quite some time, we request the learned Trial Court to expedite the trial to the fullest extent possible and conclude the same at an early date and positively within a year from the next date fixed for recording of evidence.

6. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
