1. The petitioner is aggrieved as there has hardly been any progress in connection with Ekbalpore Police Case No.117 of 2025 dated 28.03.2025. The petitioner states that although the said criminal law is in motion because of the reluctance on the part of the Investigating Agency, the sufferance of the petitioner has not been resolved.

2. According to the petitioner, proper witnesses have not been examined and certain persons have been examined who are in no way associated with the case.

3. Be that as it may, since the investigation is in progress, at this stage, the Court cannot interfere as to how the Investigating Agency would investigate the case.

4. I find from the records that the case was registered on 28.03.2025.

5. Having considered that more than 90 days have passed since the case was registered, the Investigating Officer will send a progress report in respect of the investigation to the present petitioner. In case, there is any grievance, the same be brought to the notice of the Investigating Officer.

6. If the said grievances are not addressed by the police authorities after submission of the report under Section 193 of BNSS, the petitioner would be at liberty to canvass his grievances before the learned Court. 7.

The learned advocates for the private respondent as well as the State are present.

8. Since, the case is at the stage of the investigation, the learned advocate for the State opposes the prayer advanced in the writ petition.

9. Be that as it may, in view of the direction passed above, further pendency of the writ petition is unwarranted.

10. With the aforesaid observations, WPA 16755 of 2025 is disposed of.

11. Report so submitted be kept with the records.

12. Urgent photostat certified copy of this order may be supplied to the parties upon all formalities, if applied for.
