Learned advocate appearing for respondent no. 6 vehemently opposes the prayer of the petitioner. It is submitted that respondent no. 6 has instituted Title Suit No. 279 of 2025 before the Civil Judge (Junior Division), 1st Court, Baruipur, seeking eviction of the petitioner from the said premises, alleging that the petitioner is a mere trespasser.

Learned advocate appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that an inspection was conducted pursuant to the petitioner's application for a new electricity connection. However, a fresh inspection is required. It is further submitted that the petitioner is presently availing electricity through a

sub-meter, which will need to be disconnected in order to effect the new connection.

Since the settled possession of the petitioner over the premises in question is not in dispute, I am of the considered view that the petitioner is entitled to obtain a separate electricity connection.

Accordingly, this writ petition is disposed of with a direction upon WBSEDCL to effect an electricity connection in favour of the petitioner within a period of six weeks from date, subject to compliance with all necessary formalities.

If required, the officials of WBSEDCL shall be assisted by the Officer-in-Charge of the local police station for conducting the inspection and effecting the electricity connection. The cost of such police assistance shall be borne by the petitioner.

It is further clarified that the grant of this electricity connection shall not create any right, title, or interest in favour of the petitioner and shall have no bearing on the pending civil suit between the parties.

Accordingly, WPA 16799 of 2025 is disposed of.
