Mr.Gangadhar Das Mr. Tanmoy Chattopadhyay ..for the petitioner Ms. Sahina Sumi ....for the State No report has been submitted by the State despite being granted several opportunities. The matter is taken up for consideration.

Learned counsel for the petitioner submits that pursuant to a tender floated by Salaidanga Gram Panchayat on January 19, 2021 for supply of construction material for various work and on the basis of work orders issued in this regard, the petitioner firm delivered construction material worth of Rs.1,37,20,080/-. The challans submitted by the petitioner to that effect have been counter-signed by the Pradhan, Salaidanga Gram Panchayat. The petitioner alleges that not a single farthing has been paid to the petitioner for supply of the said construction material. The petitioner submitted several representations before the concerned authority for clearance of his bills which were not heeded to. The petitioner seeks payment of his dues.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that

since the petitioner has apparently supplied construction material in terms of the work orders issued in his favour and the challans submitted by him have been counter signed by the Pradhan, Salaidanga Gram Panchayat, the Block Development Officer, Gazole Development Block, being the 6th respondent herein, is directed to consider the representation submitted by the petitioner upon granting reasonable opportunity of hearing to him and take necessary steps for disbursal of the dues of the petitioner subject to verification of the documents submitted by the petitioner as well as complying with all necessary formalities.

The entire exercise should be completed within six weeks from the date of communication of this order. The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
