Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the unmarried daughter of the deceased employee. She has prayed for family pension, especially in view of the memorandum no. 138-F (Pen) dated 03.03.2008 issued by the Finance Department, Pension Branch, Government of West Bengal. Such application was made before the Principal of the employer College. But, the same has not been responded to as yet.
Learned counsel appearing on behalf of the State submits that the representation has to be made to the respondent no.3 or forwarded by the Principal to the respondent no.3 for due consideration.
In view of the above, the petitioner shall be at liberty to file a fresh representation in this regard before the respondent nos. 3 and 5 within a week from this date. Within six weeks from such date, the respondent no.3 shall consider the petitioner's representation in accordance with law and intimate the outcome of such consideration to the petitioner within a week thereafter.
With these observations, the writ petition is disposed of.
