1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Petitioner applied for transfer on general ground (distance) on 15th July, 2022 on portal and grievance of the petitioner is transfer application is yet to be processed and decided by the concerned respondent authorities.

3) Respondents are represented by learned advocates who have submitted that petitioner is single teacher in the subject in higher secondary section of the school. Since petitioner is single teacher in the subject in the school Government Notification dated 3rd January, 2022 is required to be followed by the respondent authorities.

4) In view of respective submissions made on behalf of the parties, Head of the Institution of Moula Netaji Vidyalaya (HS), Howrah being respondent no. 6 is directed to forward transfer application of the petitioner to the District

Inspector of Schools (SE), Howrah being respondent no. 5 by fortnight from date of communication of this order. On receipt of transfer application, respondent no. 5 is directed to make endeavour to find out a teacher from neighbouring school who can be deputed in place of petitioner thereby facilitating petitioner's transfer in terms of the said Government Notification dated 3rd January, 2022. In the event teacher is found from neighbouring school to be deputed in place of petitioner, petitioner shall be transferred immediately thereafter.

5) Writ petition stands disposed of.

6) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
