......Petitioner.

Mr. Prolay Bhattacharyya, Ms. Tanusree Ghosh, ......for the Petitioner.

Mr. Antarikhya Basu, Ms. Kanchan Roy, ......for the State.

Dictated by Prasenjit Biswas, J.

1. Learned advocate for the petitioner submits that the petitioner is in custody since March 7, 2023. She is completely innocent and she has been falsely implicated with the alleged crime. It is further submitted by the learned counsel that there is no immediate change of early conclusion of the trial and so the petitioner may be granted bail on her prolonged incarceration.

2. Learned counsel appearing for the State raises vehement objection by submitting that there are sufficient incriminating materials against this petitioner which have been gathered by the investigating agency in the case diary. Our attention Signed By :

SANDIP DE High Court of Calcutta 3 rd of September 2024 11:08:08 AM

is drawn to the statement of witnesses recorded under Section 164 Cr.P.C.

3. We have perused the documents as produced by the investigating agency and also have gone through the statements of the witnesses recorded under Section 164 Cr.P.C. The documents as gathered in the case diary reflects about the prima facie involvement of this accused petitioner with the alleged offence. Moreover, the offence has been allegedly committed in a diabolical manner. So we are not inclined to enlarge the petitioner on bail.

4. CRM (DB) 2194 of 2024 is dismissed.

5. It is further submitted by the learned counsel appearing for the State that evidence taking process has already started and 3 out of 25 charge-sheet named witnesses have already been examined.

Accordingly, the learned trial Court is, hereby, directed to take appropriate steps to expedite the trial and conclude the same within 1 year from the date of communication of this order.

6. Let this order be communicated by the parties to the learned trial Court.
