AGP Ms. Sumita Shaw Mr. Soumen Chatterjee ... for the State-respondent (s) Ms. Mary Datta ... for the Union of India The petitioner, being aggrieved, has approached this court as there is no progress in the investigation of Nazat PS Case No. 559 of 2024. The said case was registered under Section 103(1)/3(5) of the BNS.

It is reflected from the report submitted by the State that in course of the investigation, the police authorities arrested four accused persons; post-mortem report was collected which reflects that the strangulation on the body of the deceased

was homicidal in nature; statement under Section 183 of the BNSS in respect of the two witnesses were recorded; Memory Card which was inserted in the CCTV camera installed at the house of the complainant was checked and the surrounding areas of the place of occurrence was also inspected. The report also speaks that the FSL team visited the pond and examined the place using investigation kits. The Cell drums at the place of occurrence under Nazat PS was collected with the technical assistance of SOG, Basirhat Police District and after being analysed in course of the investigation materials surfaced, consequently, arrest were effected. The investigation of the case is still under progress as notices have been issued for examination of certain witnesses.

Having considered the totality of the circumstances, I am of the view that the investigation, at this stage, is

progressing, but, regard being had to the stage of the case and the investigation of a murder case being in progress, I direct the SDPO in charge of Minakhan Police Station to supervise the investigation of Nazat PS Case No. 559 of 2024 dated 07.12.2024.

As more than eight months have passed, a progress report, at this stage, must be handed over to the defactocomplainant. It is further directed that on each and every month till the report under Section 193 of the BNSS is submitted before the court, the superior officer of police himself will submit the report regarding the progress of the investigation to the learned ACJM, Basirhat.

With the aforesaid observations, WPA 16765 of 2025 is disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
