1. The learned advocate representing the petitioner has filed supplementary affidavit which inter alia stating that on refusal of this Court to accept joint compromise petition in CRR 2810 of 2011 and CRR 674 of 2009 the petitioner is willing to face the trial and accordingly prayed for the proceedings of G.R Case No. 936 of 2007 pending before the Court of learned Chief Judicial Magistrate, Jalpaiguri and CR Case No. 10 of 2008 pending before the Court of learned Additional Chief Judicial Magistrate, Gangarampure, Buniyadpur, Dakshin Dinajpur be tried together at the same Court.
2. The aforesaid proceedings include parties who are the same in the proceedings being the de-facto complainant in one case and the accused in another case.
3. Under such circumstances, this Court finds it prudent that both the cases should be heard by the learned Chief Judicial Magistrate, Jalpaiguri and the case record of CR Case No. 10 of 2008 pending before the Court of the learned Additional Chief Judicial Magistrate, Gangarampure, Buniyadpur, Dakshin Dinajpur be transmitted to the Court of learned Chief Judicial Magistrate, Jalpaiguri for final disposal.
4. Accordingly, these revisional applications are disposed of.
5. The pending applications, if any, stands disposed of.
6. Copy of this order be communicated to both the trial courts as aforesaid for necessary actions.
